Terms of Service
These terms apply when you engage Verhey Plastering Pty Ltd (ABN 88 702 567 495) for plastering and rendering services in Perth, Western Australia, and when you use our website at https://verheyplastering.site. By accepting a quote from us or using this website, you agree to these terms.
1. About these terms
Verhey Plastering Pty Ltd trades from Perth, Western Australia, providing internal and external plastering, rendering and related wall and ceiling finishes. In these terms, “we”, “us” and “our” refer to Verhey Plastering Pty Ltd, and “you” refers to our client or a user of this website.
2. Quotes and estimates
- All quotes are prepared based on the information you provide and, where practical, an inspection of the site.
- Quotes are valid for 30 days from the date of issue unless otherwise stated in writing.
- A quote is an estimate of the cost to complete the described scope of work. It may change if the scope changes, if site conditions differ materially from what was described, or if unforeseen issues such as damaged existing surfaces or hidden structural defects are discovered once work begins.
- We will advise you of any proposed variation and its cost before proceeding, unless it is not reasonably possible to do so.
3. Acceptance and scope of work
- Work is commenced once you accept a quote in writing (including by email) or make a deposit payment.
- The scope of work is limited to the items listed in the accepted quote. Anything not listed, such as paint, decorative finishes, structural repairs, waste removal beyond what is quoted, or work to surfaces not specified, is excluded unless agreed in writing.
- Any change to the agreed scope must be confirmed in writing (including by email) and may affect price and timing.
4. Payment
- Deposits and progress payments may be required as set out in your quote. Final payment is due on completion of the work described in the quote.
- Payment methods will be advised on your invoice. We do not charge card surcharges beyond any amount disclosed before you pay.
- Invoices not paid by the due date may attract reasonable late payment costs, and we may suspend further work until outstanding amounts are settled.
- You must not withhold payment except to the extent permitted by law, including where a genuine dispute exists about part of an invoice.
5. Access and client responsibilities
- You must provide safe, reasonable access to the work area at agreed times, including clear space around walls and ceilings to be finished.
- You are responsible for securing pets, moving fragile or valuable items away from the work area, and providing access to power and water where reasonably required.
- Delays caused by lack of access, incomplete prior trades, or site safety issues may result in additional reasonable costs.
6. Cancellation
- You may cancel scheduled work by written notice (including email) before the scheduled start date.
- Where work has been cancelled with short notice, or materials have been specially ordered for your job, we may charge reasonable costs already incurred.
7. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), including consumer guarantees that services will be provided with due care and skill, that they will be fit for purpose, and that they will be supplied within a reasonable time.
Our services also come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to cancel the contract and obtain a refund, or to have the failure remedied. For minor failures we may choose to remedy the failure within a reasonable time.
If you believe our work has not met the required standard, please contact us first so we can inspect and, where appropriate, rectify the issue.
8. Liability
- To the extent permitted by law, our total liability for any claim arising from our services is limited, at our option, to re-supplying the affected services or the cost of re-supplying them.
- We are not liable for defects in existing structures, movement or cracking caused by structural issues, water ingress from other sources, or work carried out by other trades before or after ours.
- We are not liable for indirect or consequential loss, except where such exclusion is not permitted by the Australian Consumer Law.
9. Website content
- Content on this website is general information about our plastering and rendering services. It is not trade, legal or financial advice, and it does not form part of any contract for work.
- Images and descriptions are indicative only. The final finish on your project depends on site conditions, substrate, materials and the agreed scope.
- The text, layout and branding of this website are owned by Verhey Plastering Pty Ltd. You may not copy or reuse them commercially without our written permission.
- We aim to keep this website accurate and available, but we do not promise it will always be complete, current or uninterrupted.
10. Governing law
These terms are governed by the laws of Western Australia, and the parties submit to the jurisdiction of the courts of Western Australia. This does not limit any right you have to bring proceedings under the Australian Consumer Law in a tribunal with relevant jurisdiction, including the Commissioner for Consumer Protection in Western Australia.
11. Changes to these terms
We may update these terms from time to time. The current version will always be published on this page. For any existing contract for work, the terms in place at the time you accepted your quote will continue to apply unless you and we agree otherwise in writing.
